Terms of Use

These Terms of Use ("Terms") apply to the mobile game Sea of Fruits ("the Game") published by Sea of Fruits ("we", "us"). By downloading or playing the Game you agree to these Terms. If you do not agree, please do not play the Game.

If you downloaded the Game from the App Store, Apple's Licensed Application End User License Agreement also applies. If you downloaded it from Google Play, the Google Play Terms of Service also apply.

1. Your licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment. The Game, its characters, art, music, code and all other content belong to us or our licensors. All rights not expressly granted are reserved.

2. Your account

• You can play as a guest or sign in with Apple Game Center or Google Play Games. You are responsible for activity on your account and for keeping access to your device and sign-in secure.
• Progress of a guest account is linked to your device. If you delete the Game or change device without signing in, it may be lost.
• You must be old enough to agree to these Terms in your country, or have your parent's or guardian's permission.

3. Virtual items and currency

• The Game contains virtual currency (such as gold, pearls and doubloons) and virtual items (such as fruits, ships, chests, gear and the battle pass). Some can be bought with real money.
• Virtual currency and items are licensed to you for use in the Game only. They have no real-world monetary value, cannot be exchanged for money or anything outside the Game, and cannot be sold, traded or transferred outside the features the Game provides.
• Some items are unique in an online world and may move between players according to game rules (for example, a magic fruit returns to the world if its owner is inactive for a long time).
• Purchases are final, except where the law of your country or the store's refund policy says otherwise. Refunds are handled by Apple or Google under their own policies.
• We may change, rebalance or remove virtual items and game features as the Game develops. If we stop operating the Game, virtual items will stop being available, and we will give reasonable notice where required by law.

4. Rules of conduct

When playing you agree not to:

• cheat, use bots, hacks, modified clients, exploits or unauthorised third-party software, or deliberately abuse bugs;
• interfere with servers or other players' experience, or try to access accounts or data that are not yours;
• use names or chat to harass, threaten, insult or impersonate others, to post hateful, sexual or illegal content, or to share personal information about anyone;
• sell, buy or trade accounts or virtual items for real money;
• reverse engineer, copy, modify or distribute the Game except as permitted by law.

We may filter or remove names and messages, mute or rename players, and suspend or terminate accounts that break these rules, with or without notice, depending on how serious the violation is. You can report players in the Game, and block them so that you do not see their messages.

5. Online service and updates

The online world requires an internet connection and may be unavailable from time to time because of maintenance, updates or problems beyond our control. We may release updates, and some updates may be required to keep playing. The Game is provided "as is" and "as available".

6. Disclaimer and limitation of liability

To the maximum extent permitted by law, we do not give warranties that the Game will be uninterrupted or error-free, and we are not liable for indirect, incidental or consequential damages, or for loss of data, progress or virtual items. Our total liability to you is limited to the amount you paid for the Game and in-game purchases in the 12 months before the claim. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

7. Privacy

Our Privacy Policy explains what information we collect and how we use it.

8. Changes and termination

We may update these Terms. If the changes are significant, we will let you know in the Game. If you keep playing after the changes take effect, you accept the new Terms. You can stop using the Game at any time and ask us to delete your account (see the Privacy Policy).
